1. Contract: A binding contract will exist between you (the Customer) and us (Good Intents) when Good Intents has received a signed reservation form and deposit.

 

2. Conditions: These conditions apply to the hire of all items including marquees and any other piece of equipment by us to you. The terms of these conditions can only be altered with our written agreement.

 

3. Payment Terms: We charge a deposit as stated on our quotation, the balance is due prior to delivery of equipment.

 

4. Cancellation: If you cancel the contract you will be liable to pay the following charges, depending on the period of notice given prior to commencement of the hire, or if it is necessary to cancel due to adverse weather conditions.

• More than 45 days – 25% of hire charges
• 14-45 days – 60% of hire charges
• Less than 14 days – 100% of hire charges

 

5. Delay or failure to Complete: We shall not be liable, and you will be responsible for the full hire cost as a result of:

5.1   The site being unsuitable e.g. grass site not water logged, covered by snow

5.2  The site being unavailable at time of delivery

5.3  Adverse wind and weather conditions, including Met Office forecasted conditions

5.4  Loss or damage to equipment by fire or flood

5.5  Any industrial dispute, lock out or strike

5.6  Any cause outwith our control

 

6. Delivery to Site: The timing will be agreed prior to the commencement of hire and you must ensure:

6.1  The site is well drained, even and mown, and is available and accessible for all vehicles.  The cost of any corrective arrangements to overcome the difficulties resulting from the above will form an additional charge

6.2  Your representative is present to check delivery and confirm siting of marquees and equipment

6.3   If no one is present you will be deemed to have accepted the delivery and our siting of the marquee and equipment and will be liable for the cost of any changes

6.4  You have made us aware of any services or obstructions concealed beneath the ground, which could hinder or cause injury

6.5   Welfare facilities (WC and hand wash facilities) are made available

 

7. Equipment on Site: You are responsible for the safe custody of all equipment while on site:

7.1  Maintain adequate heat to protect against frost, snow and ice damage

7.2  Firmly close all openings when not in use when windy conditions prevail

7.3  Suspend nothing from the structure of marquees without our written consent

7.4   You must make good to us any loss or damage including cleaning costs when incurred

7.5  No pinning to marquee linings or use of adhesive materials on our equipment

 

8. Insurance: We strongly recommend you obtain adequate insurance cover for clause 7 above in respect of adverse weather, theft, fire and vandalism and cancellation.

 

9. Limitation of Liability:

9.1  If we fail to fulfil any terms of this contract our liability is limited to refund or cancellation of hire charge.  Under no circumstance shall we be liable for any indirect, special or consequential loss or damage

9.2  Any loss or damage caused by ourselves, our employees or agent shall not exceed the amount of the hire charges. This condition does not apply to death, personal injury caused by negligence or losses arising out of fraudulent misrepresentation by us

9.3   We will not be liable for any loss or damage to property or equipment owned by yourselves or in your care stored in our marquees

9.4  We shall not be liable for the repair or reinstatement of property after removal of our equipment
